目前,由于刑法对受贿型渎职犯罪在立法上的空白,给司法实践带来了困惑,不利于司法机关对受贿型渎职犯罪准确地定罪量刑。渎职行为与受贿行为之间并非牵连关系,两罪在犯罪构成上也非重合关系。对于渎职受贿罪应当以受贿罪和渎职罪数罪并罚论处,这种处断原则并不违背禁止重复评价原则,更能体现罪刑相适应原则。
