在司法实践中,检察建议为强化检察机关履行法律监督职能发挥了重要作用,但检察建议在司法适用中普遍存在质量不高、针对性不强、回复与采纳率偏低等问题。为使检察建议真正有效地实现法律监督的目的,应提高检察人员素质,细化检察建议的实践操作,完善检察建议的异议处理机制,保障检察建议工作落到实处。
재사법실천중,검찰건의위강화검찰궤관리행법률감독직능발휘료중요작용,단검찰건의재사법괄용중보편존재질량불고、침대성불강、회복여채납솔편저등문제。위사검찰건의진정유효지실현법률감독적목적,응제고검찰인원소질,세화검찰건의적실천조작,완선검찰건의적이의처리궤제,보장검찰건의공작락도실처。
In judicial practice,procuratorial recommendations play an important role in strengthening procuratorial organs＇ fulfilling the legal supervision function.However,there are some problems such as low quality,poor pertinence,low response rate and adoption rate,and so on in judicial application of procuratorial recommendations.We should improve the quality of the procuratorial personnel,refine the practice of procuratorial recommendations,perfect objection handling mechanism of procuratorial recommendations,and guarantee the implementation of procuratorial recommendations in order that procuratorial recommendations can really and effectively realize the purpose of legal supervision.
