＂幽灵抗辩＂是犯罪嫌疑人或被告人在刑事诉讼中为减轻或者免除其刑事责任而提出的无罪或罪轻的辩解,在司法实践中,如何从证据上对其抗辩进行排除是一大难题。在大陆法系职权主义的诉讼模式,被告人不承担举证责任,侦查机关要搜集证明被告人主客观方面的相关证据,难度很大。我国应借鉴英美法中的＂积极抗辩＂制度,思考侦查机关和检察机关如何履行好举证责任,从而通过举证来排除被告人的辩解。

＂Ghost defense＂ is a kind of exculpatory excuse for innocence or misdemeanor put forward by the suspect or the defendant in criminal procedure in order to reduce or waive their criminal responsibility.In judicial practice,it is a difficult problem how to raise a plea against it for exclusion through evidence.In the litigation model of terms of reference in civil law,the defendant does not bear the burden of proof.The investigative organs should collect relevant evidence to prove the defendant＇s subjective and objective factors and have many difficulties.We should learn ＂active defense＂ system from common law,think actively about how investigative organs and procuratorial organs can carry out the burden of proof,and therefore exclude the defendant＇s excuse through means of proof.
