目前,我国商业贿赂蔓延的领域更加广泛且形式愈加隐蔽和多样化,使得市场经济的健康成长存在诸多隐患。文章从经济法角度分析我国规制商业贿赂在立法制度上的缺陷及实施反垄断法出现的问题,提出补救缺陷的建议：制定专门的反商业贿赂法;加大行政处罚力度及转化政府职能;建立及完善相关法律制度。

At present,commercial bribery in China has spread in more extensive areas and its form has become more subtle and varied,which brings many hidden dangers to the healthy growth of the market economy.From the perspective of economic law principles,the article analyzes the defects in legislation system on the regulation of commercial bribery in our country and the problems in implementing anti-monopoly law,and then provides the following advice：making specialized law against commercial bribery,increasing the administrative penalties and transforming government functions,establishing and improving the relevant legal system.
