中国式的混合型刑事证据立法趋向契合了我国刑事诉讼模式．成为构建卧底侦查证据制度的前提性保障。卧底警察出庭作证制度是卧底侦查证据制度构建的核心．以卧底警察或侦查利益与保障人权为衡量标准，建立利益机制引导下的分层出庭作证制度。卧底侦查所获证据资料应在区分合法与非法基础上做出适当的处理，并明确另案使用的条件或限制。

Chinese-style legislation of hybrid criminal evidence fits pattern of criminal proceedings in China.It is the protection to establish the evidence of undercover investigation.Undercover police testifying in court is to establish the evidence of undercover investigation.We should establish the hierarchical system of testifying under the guidance of mechanism of interest by measurement between the benefits of undercover police or investigation.The evidence of undercover ＇investigation should be handled on the basis of distinction between legal and illegal and make clearly the conditions or restrictions to use in another case.
