随着社会经济的发展，在当前新型医患关系背景下，患者的自我权利保护意识越来越强烈，加之其对高质量个体化医疗服务的要求，使得在医疗实践中由于患者知情不同意导致医方诊疗过程受阻的情况不断出现，给临床医师带来了新挑战。本文从“知情不同意”的法律内涵着手，归纳其类型并分析其原因，指出对不同医疗模式下患者知情不同意的规制对策，并对患者的知情不同意提出一些法律方面的思考。

With the development of social economy, under the background of the current new doctor-patient relationship, patients' self consciousness of right protection is becoming more and more intense. Combined with the demand for high-quality individualized medical care, the process of diagnosis and treatment is hindered due to informed discontent in medical practice, which puts forward new challenges to the clinicians. Starting from the legal connotation of "informed discontent", this paper summarizes its types and analyzes its reasons, points out some regulation measures for informed discontent in different medical modes, and puts forward some legal reflec-tion on patients'"informed discontent".
