劳动关系是社会最基本的关系之一,由于劳资双方利益的对立性,劳动争议也一直存在。我国现行的劳动争议处理制度诞生和发展于传统计划经济体制向社会主义市场经济体制过渡的过程之中,随着我国社会主义市场经济的发展和经济体制改革的不断深入,现行的劳动争议处理制度在制度构建和实践中都存在着诸多问题。通过分析我国劳动争议处理制度存在的缺陷,提出进一步完善我国劳动争议处理制度的建议,以更好地适应社会主义市场经济的发展需要。

Labor relation is one of the basic social relationships in the world.As the interest of the labor sides is opposite,labor disputes have always been in existence.China＇s current labor dispute settlement system was born in the process of transformation from the traditional planned economy to the socialist market economic system.With the development of China＇s socialist market economy and the deepening reform of the economics,many problems have arisen in the system construction and practice of the current labor dispute settlement system.The paper aims at accelerating the reform and improvement of China＇s current labor dispute settlement system so as to adapt to the needs of the socialist market economic development by reflecting on China＇s current labor dispute settlement system.
