    法定和裁量实际上代表了两种不同的模式——法定证据制度和自由裁量制度。文章以这两种证据制度为参照物,客观分析我国民事证据制度模式的现状,进而从法定与裁量的角度入手,探寻适合我国国情的民事证据制度模式。

    The legal and discretion actually represent two different modes:legal evidence system and discretionary system. Taking the two evidence systems as reference, the article objectively analyzes the current situation of the mode of China' s civil evidence system, and then explores the mode of civil evidence system suitable for China' s national conditions from the point of view of legal and discretion.
