The Law on Improvement the Patients’ Rights of Germany is the latest German legislation on patient protection. The law summarized the traditional German case law and amended the German Civil Code correspondingly, the main content of which includes the essence of the medical treatment contract and main obligations of physicians, especially the allocation of burden of proof in medical disputes.
