目前学界对于合伙之共有的性质应作何种界定仍然存在争议。对共同关系和份额的理解不同导致了结论的不同；同时，中外对于共同共有、按份共有等概念的定义及翻译不同进一步扩大了争议。从合伙之共有的历史沿革进行分析，合伙之共有经历了从按份共有到共同共有的发展过程，在这一趋势下，将合伙之共有的性质界定为共同共有更为客观。

Nowadays ,scholars share different views on the nature of partnership property . The different comprehension of common relation and share led to different results .Meanwhile ,Chinese and overseas scholars share different views on the translation of joint ownership and several co - ownership ,which expand the controversy .Analyzing from the history of the partnership property , the author holds that it experienced from the development of the co - ownership to joint ownership . Under this trend , it is more objective to define partnership property as joint ownership .
