常见侵犯人类胎儿权益的医疗行为，可以发生在怀孕期间及分娩过程中，主要表现为误诊误治、分娩方式不当、医生动作粗暴等多种直接或间接损害胎儿健康权或者生命权的行为。上述各种侵权行为下的胎儿权益的保护，因胎儿出生时是活体还是死体以及是否出生而有不同院胎儿出生是活体的，按侵犯胎儿健康权来请求损害赔偿；胎儿出生时是死体或者在孕期内死亡的，按侵犯孕妇的健康权来请求损害赔偿。
