现行土地征收补偿制度确立的是一种纯粹的补偿关系,具有浓厚的计划经济色彩,缺乏对被征地农民生产和生活需求的考虑,从而导致补偿标准过低。在由此引发的一系列矛盾中,农民、农村集体经济组织、政府和开发商之间,农民处于弱势地位,土地权益得不到有效保护。为此,更新立法理念、变革制度、明晰产权、确立农民利益本位观的价值取向,构建一套完整、行之有效《集体土地征收与补偿条例》也就显得尤为必要。
現行土地徵收補償製度確立的是一種純粹的補償關繫,具有濃厚的計劃經濟色綵,缺乏對被徵地農民生產和生活需求的攷慮,從而導緻補償標準過低。在由此引髮的一繫列矛盾中,農民、農村集體經濟組織、政府和開髮商之間,農民處于弱勢地位,土地權益得不到有效保護。為此,更新立法理唸、變革製度、明晰產權、確立農民利益本位觀的價值取嚮,構建一套完整、行之有效《集體土地徵收與補償條例》也就顯得尤為必要。
현행토지정수보상제도학립적시일충순수적보상관계,구유농후적계화경제색채,결핍대피정지농민생산화생활수구적고필,종이도치보상표준과저。재유차인발적일계렬모순중,농민、농촌집체경제조직、정부화개발상지간,농민처우약세지위,토지권익득불도유효보호。위차,경신입법이념、변혁제도、명석산권、학립농민이익본위관적개치취향,구건일투완정、행지유효《집체토지정수여보상조례》야취현득우위필요。
the establishment of the current land expropriation compensation system is a pure compensation relationship,which carries apparent features of planned economy and is in the absence of consideration of landless farmers' production and living needs.The compensation standard,therefore,is fairly low.This phenomenon has created a series of contradictions amongst farmers,rural collective economic organizations,government and developers.Farmers,in this conflicts of interest,are in a weak position,and their land rights cannot get effective protection.Therefore,it is of great importance to update the legislation concept,innovate the current system,clarify the property rights,establish a value orientation in which farmers' interests prevail,and build up a set of integrated and effective"collective land expropriation and compensation regulations".
