中国特色社会主义法律体系已经基本形成，军事法在其中的地位和作用一直是军事法学界深度关注的课题。而在这一课题中最核心的就是军事法体系是否具有独立性，军事法能否成为一个独立的法律部门，这也同时关系到军事法体系及军事法学科未来的发展方向。学者们从多个角度对上述问题展开过探讨，选取以法的本质为视角对军事法体系的独立性进行论证。

The legal system of socialism with Chinese characteristics has been basically formed. The subject which military law experts deeply concerned is the status and role of the military law. The core of this subject is whether the military law system has its independence or whether the military law system can become an independent legal depart- ment. That is also related to the future direction of development of the military law system and military law disci- pline. Scholars commence on the above issues from multiple perspectives. This paper makes a thorough study of these problems from the angle of the essence of law to demonstrate the independence of military law system again .
