近年来,精神损害赔偿在我国得到了实践和发展,但在社会不断前进的今天,我国关于精神损害赔偿的相关规定存在明显缺陷,难以适应时代的发展。在系统研究我国精神损害赔偿体系的基础上,指出我国精神损害赔偿制度的不足,以期引起法律界对相关问题的重视。
近年來,精神損害賠償在我國得到瞭實踐和髮展,但在社會不斷前進的今天,我國關于精神損害賠償的相關規定存在明顯缺陷,難以適應時代的髮展。在繫統研究我國精神損害賠償體繫的基礎上,指齣我國精神損害賠償製度的不足,以期引起法律界對相關問題的重視。
근년래,정신손해배상재아국득도료실천화발전,단재사회불단전진적금천,아국관우정신손해배상적상관규정존재명현결함,난이괄응시대적발전。재계통연구아국정신손해배상체계적기출상,지출아국정신손해배상제도적불족,이기인기법률계대상관문제적중시。
The compensation for moral damages in China in recent years has been the practice and development,but there are obvious flaws in the relevant provisions of our mental damages in the continually advanced society,which is difficult to adapt to the development.The article pointed out that the insufficiency of the compensation system for moral damage on the basis of the study of compensation system for moral damage,in order to arouse the attention of the legal profession on the related issues.
