毕业前的在校大学生和用人单位签订劳动合同,依法向用人单位提供劳动,能否表明双方依法建立了劳动关系?如果在履行劳动合同过程中发生争议,是否属于劳动争议仲裁的受理范围,大学生能否得到劳动法的保护?理论界莫衰一是,在实务中,各级法院对此类案件的态度不同。本文认为,只要毕业前的在校大学生实质上为用人单位提供劳动,形式上和用人单位签订书面劳动合同,就意味着劳动关系的建立,就应当受到劳动法的保护。

It has been difficult to decide whether the parties have established labor relationship when the college students sign the employment contract with the employer and provide work. Is it within in the acceptance scope of labor dispute and could the college students be protected by labor law when disputes occur during the performance of employment contract? In practice, courts at all levels have different attitudes to cases falling in such category. In this paper the author believes that as soon as college students sign the employment contract and provide work for the employer, the labor relationship is established and the college students should be protected by labor law.
