近年来，随着我国国民经济的发展和外资金融机构的强大竞争，商业银行适应金融市场的变化推出了委托理财业务，一方面拓宽了投资者的投资渠道，另一方面也增加了银行的收入。委托理财业务在快速增长的同时，也面临着一系列的法律风险。文章从加强外部立法，加强委托理财从业人员行为的管理，建立内控机制，建立委托理财从业人员的资格认定等四个方面提出了防范措施。

As the development of the national economy and the accumulation of peoples wealth, the commercial bank entrusted to manage finances was promoted at the right moment. On the one hand, it opened up investor's investment channel, and on the other hand it also increased income of the bank. With trust management business growing rapidly, it is also faced with a series of legal risks. This article has made the prevention measures from strengthening external legislation, strengthening the management of trust management practitioners behavior, establishing internal control mechanism and building the trust management practitioners qualification.
