2012年修正后的刑事诉讼法关于侦查程序的修改，呈现出明显的扩权基础上限权的指导思想。遗憾的是，立法虽然将辨认笔录增加为证据种类，但产生辨认结果的辨认行为在侦查一章中却难觅踪影，这显然既阻碍了辨认措施功能的充分实现，也不利于规范辨认这一侦查行为。因此，有必要进一步明确辨认的法律地位，完善辨认规则，细化辨认程序。

The new Criminal Procedure Law revised in 2012 made some changes about the investigation procedure and showed the guiding principle of limiting power on the basis of power expansion. Unfortunately, although legislation has included transcripts identification as a kind of evidence, the identification behavior that produces identification results is not specified in the chapter of criminal investigation. Obviously, this situation not only hinders the full realization of the function of identification measures, but is also unfavorable for the regulation of such investigation behavior as identification. Therefore, it is necessary to further clarify the legal status of identification, to improve identification rules, and to refine identification procedures.
