死亡赔偿金的法律属性如何定位决定了死亡赔偿金的分配规则,相较于继承利益丧失说下将死亡赔偿金定性为继承人之可继承利益所遭受损害之赔偿,继承说将之定性为遗产更有其合理性。根据继承法关于法定继承人的规定确定死亡赔偿金请求权人的范围和顺位,并在确立扶养费优先分配原则的前提下,依照遗产分配的规则解决赔偿权利人间死亡赔偿金的分配问题,是当下一个较为可欲的选择。

The positioning of the legal property of the death compensation determines the allocation rules of compensation for death.Compared with the theory of inheritance interest losing which defines that the death compensation means the compensation that the inheritor gets for the lost property that he suffered,while the theory of inheritance is more reasonable to define it as legacy.According to regulations of legal heir in the inheritance law,the range and order of applicants for inheritance are determined.Another relatively desirable choice is that the death compensation distribution should be determined according to the inheritance distribution rules,under the premises of established principle of maintenance preferred to pay and distribute the death compensation among the compensation obligees.
