随着我国市场经济的不断深入和法制进程的不断加快，行政公益诉讼受到司法实务和理论研讨越来越多的重视，而行政公益诉讼的原告资格问题逐渐成为其中的热点之一。从行政公益诉讼原告资格的涵义及其理论基础入手，考察国外两大不同法系国家行政公益诉讼原告资格，并分析我国行政公益诉讼原告资格的现状，提出确定行政公益诉讼原告资格的范围，在此基础上赋予公民和检察机关行政公益诉讼原告资格。

With the continuous deepening of our countryg market economy and the acceleration of legal process, administrative public interest litigation has drawn more and more attention from judicial practice and theoretical re- search, and the administrative public interest litigation plaintiff qualification gradually becomes one of the hot spots. Starting with connotation and the theoretical basis of the plaintiff qualification of administrative public welfare lawsuit, the paper studies the plaintiff qualification of administrative public interest in two foreign countries with different legal systems of litigation, analyzes the current situation of China~ administrative public interest litigation plaintiff qualifica- tion, and suggests determining the plaintiff qualification of administrative public welfare lawsuit scope, and on this basis empowering citizens and procuratorial organs administrative public interest litigation plaintiff qualification.
