没有原告就没有诉讼。适格原告的确定，是构建环境公益诉讼制度的前提，诉之利益理论应成为扩大环境公益诉讼原告资格的理论基础。新修订的民事诉讼法规定，对污染环境、侵害众多消费者合法权益等损害社会公共利益的行为，法律规定的机关和有关组织可以向法院提起诉讼。法律对原告主体资格并未作明确的规定，借鉴国外立法并参考我国各地司法实践，人民检察院、环保组织团体、环保机关应当是环境公益诉讼适格原告，而环保组织、团体应当逐步成为环境公益诉讼的中坚力量。

Profit of actions is the theory which can expand the range of plaintiff. And the environmental protection organizations should become the dominant force.
