研究目的：通过露天矿用地特征研究,探索建立露天矿用地的合理制度。研究方法：理论分析与实证分析相结合。研究结果：露天矿用地演化过程的4个阶段分别为原地貌地类、建设用地、复垦土地和农用地,其中,只有采矿用地是真正的建设用地,露天矿用地作为建设用地具有明显的阶段性。用征地制度来管理露天矿用地,存在几方面缺陷,一不利于耕地保护,二不利于合理开发与利用土地,三不利于社会和谐。而露天矿采用租赁土地制度有助于这些问题的解决,关键是从技术上设计好租赁归还办法、从经济利益上协调矿企与地方政府的矛盾、从法律上规范租赁行为。研究结论：露天矿用地作为一种有特殊演化特征的建设用地,以租地制度来管理更加科学。

The purpose of the paper is to develop a land lease system for the strip mine land use in terms of the land characteristics.The method is to integrate the theoretical and practical analysis together.The research results showed that the evolutionary process of strip mine land use included four stages,such as original land use,land use for construction,land rehabilitation and land use for agriculture.During the four stages only when the land is used for mining can be seen as construction land use.Furthermore,there were some disadvantages if the strip mine land was acquired through the land expropriation system.Firstly,it was harmful for cultivated land protection.Secondly,it was disadvantageous for reasonable use and exploitation of land.Thirdly,it harms the social stability.However,a land lease system could solve the problems.The key problem then was how to establish a market for coordinating the benefit contradiction,and adjusting to the laws and regulations.It was concluded that strip mine land would be better to be managed with a land lease system.
