基于当前人类社会面临的发展与环境的紧张关系,明确环境保护责任的归属以及相关主体对于环境污染的预防、控制和治理等费用的合理负担,是保证社会、经济和环境可持续发展的重要制度基础。本文从法学、经济学的视角分析了污染者负担原则存在的不合理性及其在我国实施过程中面临的现实困境,提出了破解污染者负担原则所面临困境的对策。
基于噹前人類社會麵臨的髮展與環境的緊張關繫,明確環境保護責任的歸屬以及相關主體對于環境汙染的預防、控製和治理等費用的閤理負擔,是保證社會、經濟和環境可持續髮展的重要製度基礎。本文從法學、經濟學的視角分析瞭汙染者負擔原則存在的不閤理性及其在我國實施過程中麵臨的現實睏境,提齣瞭破解汙染者負擔原則所麵臨睏境的對策。

Based on the current human society development and environment tensions,clear environmental protection responsibility and related subjects for environmental pollution prevention,control and management of cost of reasonable burden,is the guarantee of social,economic and environmental sustainable development important institutional basis.This paper from the law,economics according to the analysis of polluter burden principle unreasonable and its implementation in our country faced in the process of the reality of the plight,put forward the countermeasure on the basis of the predicament of the polluter pays principle.
