环境纠纷具有复杂性、不确定性和社会性等特点，要正确对待多元纠纷解决机制。对于真正体现当事人利益的多元纠纷解决机制应当赞成，对于变形的和被滥用的多元解决纠纷机制应当抵制。为避免在多元的纠纷解决机制中迷失“自我”，应将司法手段明确为解决环境纠纷的最主要方式。因为司法裁决在解决环境纠纷中具有主导性、有效性和权威性，司法的特性要求法官尽可能在办理案件中体现法官职业规则的内涵，从而促进环境纠纷的公正解决。

The environmental dispute has the characteristics of complexity,uncertainty and sociality and so on. In order to treat the diversification of the dispute settlement mechanism correctly,we should approve the diversification of the dispute settlement mechanism which can reflect the interests of the parties and resist the deformation and a-buse. In order to avoid the“self”loss of the settlement mechanism in multivariate dispute,we should make the ju-dicial means as the main way to solve the environment dispute. Owing to the judicial decision of solving environ-mental disputes are dominated,effectiveness and authority,it requires the judge to handle a case which can reflects intension of judge occupation rules as far as possible,therefore,the environmental disputes can be fairly solved based on the judicial characteristic requirements.
