研究目的：基于中国土地规划制度设置和实施中存在的政府专断问题，提出针对性的解决方案。研究方法：以规范分析方法，研究现行土地规划制度中的权力结构，并结合国外相关制度进行比较分析。研究结果：土地规划制度权力设置严重失衡，排除了人大监督和公民参与，导致政府专断，需要建立以公民和人大为主导的土地规划制度。研究结论：以公民和人大主导土地规划，明确以宪法为依据，对于从源头上解决中国目前的土地滥用问题有借鉴意义。
연구목적：기우중국토지규화제도설치화실시중존재적정부전단문제，제출침대성적해결방안。연구방법：이규범분석방법，연구현행토지규화제도중적권력결구，병결합국외상관제도진행비교분석。연구결과：토지규화제도권력설치엄중실형，배제료인대감독화공민삼여，도치정부전단，수요건립이공민화인대위주도적토지규화제도。연구결론：이공민화인대주도토지규화，명학이헌법위의거，대우종원두상해결중국목전적토지람용문제유차감의의。
The purpose of this paper is to propose solutions on the issue of arbitrary land planning dominated by government in China. The method is normative analysis, aiming to study the power structure in the current land planning system compared with foreign systems. The results show that the power structure is imbalance seriously in the current land planning system in China. Public participation and the approval of people’s congress are lack in the system. Instead, government has all the power of planning. So, we should develop a new land planning system in the context of public participation and under an approval system from the people’s congress. It is concluded that the proposed system is consistent with the constitution of China. Furthermore, the system can solve the problem of abusing land in China.
