“错法成俗”即通过推行新法,改变社会风俗,进而实现整体的社会变革。这里的“俗”以人性自利为前提,专指人的价值观和相应的情感、行为模式,价值追求是其核心。从商鞅变法开始,秦国以“错法成俗”为变法的基本路径,以形成和法思想相统一的“俗”。秦国主要是通过国君之令强制变俗,以明确的价值引导养成风俗,对和法思想导向相违背的“俗”严厉禁止,并实行“更礼”。“错法成俗”路径的确立主要出于战争原因,它改造了社会价值观念,改变了旧的社会组织结构和生产方式,推动了整体的社会变革和君主专制集权统治的形成。“错法成俗”也使“移风易俗”成为战国到汉代一个重要的思想和政治命题。

@@@@This paper views that the social custom ,with a basis of self-interest as the prerequisite ,is human being’s social values and related affective and behavioural patterns ,taking the pursuit of value as its core concern .Then it reviews historically in Qin Dynasty that starting from Shang Yang Reform ,“wrong law as convention” :a practice and process of popularizing new social customs and transforming the existing un -desirable social customs to achieve the comprehensive social and political reform ,is the basic execution of law reform mainly through compulsory and authoritative commands and orders from the emperor to ban those customs contradictory to leading law-making notions ,thus establishing new ones consistent with ex-plicit value preferences and further calling for “a replacement of obselete customs with the new ones” .The paper concludes that the practice of “wrong law as the convention” resulting from the military and war con-cerns ,molds the social values ,transforms the social structures and productive models ,propells the who-listic social reforms ,and finally constitutes the formation of the centralization of monarchy ,making the so-cial custom reformation as an important ideaological and political topic from Warring Period to Han Dynas -ty .
