我国法律确认学生所享有的各项权利，但在对学生权利的法律保障方面，还存在一定的缺陷和不足，甚至在局部问题上存在重大的缺陷，这些都有待于进一步的研究和改善。解决大学生法律权利保障问题已是当务之急，因此必须引导大学生树立现代法律意识，增强法律意识，提高学生维权能力，完善高等教育的相关法律法规，建立完备的司法救济体系为学生维权提供法律保障。
