　　从法社会学的观点来看，法不仅仅是指国家制定的法律，还包括广泛存在的影响人们行为选择的组织规范、社会习惯，以及自我行为方式等其它规范。农地抵押除了受国家法律和政策这一正式规则约束外，还受农地的自然禀赋条件、农村社会的人情约束机制，以及农民的恋土情结所导致的自我行为约束等非正式约束条件的影响。这些约束机制很少单独起作用，而是相互交织在一起，共同影响农地抵押的实际发生。因此，我国农地抵押立法的态度是：制订系统的农地抵押正式规则，同时给农地抵押的非正式约束条件留下足够的适用空间。

From the point of the sociology of law, the law refers to national laws, and also includes other norms on organization practices, social habits, and self behaviors which influence choices of behavior. Constrained by o?cial national laws and policies, the farm mortgage is also constrained by natural conditions, the human relations of the rural society and farmer’s self-behavior control caused by their land complex. These constraints often work together to affect the actual occurrences of farm mortgage. Therefore, the legislation of farm mortgage in China must devise offcial systematic rules of farm mortgage and leave su?cient room for the uno?cial constraints of farm mortgage.
