我国法学教育呈现出不少与司法考试相抵牾的欠衔接之处,二者在“教什么”和“考什么”、“怎么教”和“怎么考”方面的匹配程度亟需衔接。法学本科教学主要是通识教育,应关注价值、规范和事实三个维度;其中,规范学习是根本,案例学习和理论学习是规范学习的深化。法学本科教学课堂模式只有突出其模式自身的“比较优势”才能自证其合理性;以教师激情触发学生兴趣,使课堂教学成为一个真正有效的过程并获得良好的教与学的效果。

아국법학교육정현출불소여사법고시상저오적흠함접지처,이자재“교십요”화“고십요”、“즘요교”화“즘요고”방면적필배정도극수함접。법학본과교학주요시통식교육,응관주개치、규범화사실삼개유도;기중,규범학습시근본,안례학습화이론학습시규범학습적심화。법학본과교학과당모식지유돌출기모식자신적“비교우세”재능자증기합이성;이교사격정촉발학생흥취,사과당교학성위일개진정유효적과정병획득량호적교여학적효과。
The legal education in China does not match well with National Bar Examination on many aspects.The extent of matching between ‘what to be taught’and ‘what to be examined’,‘how to teach’and ‘how to examine’,needs to be improved urgently.Legal teaching for undergraduates should be regarded as general teaching.It mainly concerns with three dimensions of value,norm and fact,of which study of norm stands on the root while study of fact and value an in-depth learning.The class model of legal teaching for undergraduates can only be justified through emphasis on its own comparative advantages.When students’interest is inspired by teacher’s enthusiasm,the class teaching develops into a truly effective process and leads to satisfying effect of teaching and learning.
