近年来，危机管理被应用于包括自然灾害在内的社会危机事件的应对中，形成一套行之有效的方法。但危机理论应用于防灾减灾的基本机理以及由此反射到法律建构层面的一些问题仍存在很多的研究空间。该文从成因、概念、应对阶段三个方面论证了自然灾害的危机属性，解决了危机理论对于自然灾害的可适用性问题。在此基础上尝试用危机的因素分析防灾减灾的复杂性、局限性、极限性和相关性等特征及对策。最后以危机的视角反思现存防灾减灾法律法规，提出防灾减灾法制应兼顾平时与灾时、覆盖减灾全过程、协同政府与社会以及防、救并重等建议，以期完善防灾减灾法制，为公众的安全提供更为有力的保障。

In recent years,the crisis management theory is used to deal with social crisis event including na-ture disaster and worked very well.There is still space for research to the theory using to legislation of disaster pre-vention and reduction.This paper studies the crisis nature of the nature disaster by examining its cause,definition and commonality in the emergency response stage.In this respect,it resolves the problem of how to apply the crisis theory to nature disaster,on the basis of which,it attempts to analyze the characteristics of the disaster prevention and reduction process:its complexities,its limitations,limits and its correlation using the four factors of the crisis. It then examines the existing law and regulations on disaster prevention and reduction.It concludes by offering some suggestions on how to better the legislation,including the field of non-normal legislation,the establishment of the co-governance system,and laying special emphasis on both the prevention and the saving process in China′s disas-ter-prevention culture.
