From an empirical perspective, factors that affect the application scope of the legal form of a contract contain the value amount of sub-ject matter, the nature of the contract, the time for contract performance, and public policy. The attention paid by Law to contract parties’contracting ability is the basis for the prosperity of the application scope of the legal form. On the basis of interests balance, legislators should look for homeosta-sis points between freedom way and substantive equality.
