执行通知制度作为我国一项特色执行制度，是强制执行与说服教育相结合理念的具体体现。然而在实践中，该制度的施行造成了纵容被执行人逃债等客观问题的存在。针对这些问题，一场关于执行通知制度的存废之争就此展开。2007年《民事诉讼法》的修改并未废除执行通知制度，只是新增执行员可以立即采取强制执行措施。而2012年《民事诉讼法》也继续保留了执行通知制度，仅删除了其中关于履行期限的规定，就此立即执行制度予以确立并强化。

The system of notice of execution is a system that reflects the idea of our nation’s civil procedure law. But it has brought about lots of problems since its implementation. Debates on the abolition of the notice of execution are continuing. The new civil procedure law retained the system of notice of execution but abolished the regulation about the deadline of performance, so that the system of immediate execution has been built up and strengthened.
