我国失业保险法自1986年启动以来已经有了很大的发展，在保障失业人员基本生活方面发挥着不可替代的作用。随着时代的变迁，失业保险法不仅仅是为了保障劳动者在失去工作后的基本生活，同时它还起了一个促进就业的功能。但是在实际操作中，笔者发现往往保障功能发挥比较大的作用，而对就业的作用常常被弱化甚至是忽视。同时，我国严峻的就业形势又迫在眉睫，如何化解当前面临的过大的就业矛盾和压力，已成为我国必须面对的重大难题。笔者希望通过对我国失业保险法促进就业方面的分析，阐明其促进就业缺失的原因，提出相关建议完善我国的失业保险立法，弥补其功能缺失。
아국실업보험법자1986년계동이래이경유료흔대적발전，재보장실업인원기본생활방면발휘착불가체대적작용。수착시대적변천，실업보험법불부부시위료보장노동자재실거공작후적기본생활，동시타환기료일개촉진취업적공능。단시재실제조작중，필자발현왕왕보장공능발휘비교대적작용，이대취업적작용상상피약화심지시홀시。동시，아국엄준적취업형세우박재미첩，여하화해당전면림적과대적취업모순화압력，이성위아국필수면대적중대난제。필자희망통과대아국실업보험법촉진취업방면적분석，천명기촉진취업결실적원인，제출상관건의완선아국적실업보험입법，미보기공능결실。
The Unemployment Insurance Act has made great progress since the 1986 , which plays an irreplaceable role in the protecting the basic life of the unemployed. As the generation changes , Unemployment Insurance Act is not only to guarantee the basic life of the workers who lost their jobs , but also to play a function to promote employment. However, in practice, it plays a larger role in life subsistence, but the role in promoting employment tends to be weakened or even ignored. Meanwhile , the employment in China is not optimistic. It’s quite a major issue to effectively alleviate the current excessive pressure on employment and social conflicts. This paper clarified the reasons why the act failed playing a role in promoting employment by analyzing the Unemployment Insurance Act , and it gave some suggestions to improve the unemployment insurance legislation in China.
