从刑罚改革与发展的趋势来看，资格刑刑种的丰富有现实必然性。与自由刑的减刑、假释制度相匹配，建构资格刑的复权制度是十分必要的。这不仅因为复权制度有其存在的普遍正当性，也有别于前科消灭、赦免制度的特殊正当性。基于此，考虑到在资格刑执行过程中重建犯罪惩治与人权保障方面的需要，我们应当及早建立中国刑事复权制度。

종형벌개혁여발전적추세래간，자격형형충적봉부유현실필연성。여자유형적감형、가석제도상필배，건구자격형적복권제도시십분필요적。저불부인위복권제도유기존재적보편정당성，야유별우전과소멸、사면제도적특수정당성。기우차，고필도재자격형집행과정중중건범죄징치여인권보장방면적수요，아문응당급조건립중국형사복권제도。
According to the trend of the reform and development of penalty, it is inevitable that the types of punishment against qualifications should be expanded. Matching to the commutation and parole, it is necessary to establish the system of rehabilitation of punishment against qualiifcations. The rehabilitation was not just its universal legitimacy but special legitimacy. Therefore, considering the need for reconstructing the balance of criminal punishment and protection of human rights, we should start creating the Chinese rehabilitation system as early as possible.
