录音制作者权是一项重要的邻接权，与公众生活息息相关。基于此，本次《著作权法》中关于录音制作者权的修改引起了各方面的热烈讨论。文章对录音制作者权的产生、发展及现状进行梳理，在此基础上讨论制作录音制品法定许可制度的存与废、录音制作者的二次获酬权以及数字技术背景下录音制作者权的保护等相关问题，并对当前录音制作者权制度的发展提出看法。
錄音製作者權是一項重要的鄰接權，與公衆生活息息相關。基于此，本次《著作權法》中關于錄音製作者權的脩改引起瞭各方麵的熱烈討論。文章對錄音製作者權的產生、髮展及現狀進行梳理，在此基礎上討論製作錄音製品法定許可製度的存與廢、錄音製作者的二次穫酬權以及數字技術揹景下錄音製作者權的保護等相關問題，併對噹前錄音製作者權製度的髮展提齣看法。
록음제작자권시일항중요적린접권，여공음생활식식상관。기우차，본차《저작권법》중관우록음제작자권적수개인기료각방면적열렬토론。문장대록음제작자권적산생、발전급현상진행소리，재차기출상토론제작록음제품법정허가제도적존여폐、록음제작자적이차획수권이급수자기술배경하록음제작자권적보호등상관문제，병대당전록음제작자권제도적발전제출간법。
The right of producers of phonograms is an important part of neighboring rights, having a close relationship with public lives.That's why the modification on rights of producers of phonograms in the Copyright Law of China aroused heated discussions of various parties.This paper will sort out the generation, development and current situation of rights of producers of phonograms, as well as the attitude to the statutory licensing system of phonograms, rights of remuneration of secondary uses of phonograms and issues related to the protection of rights of producers of phonograms in digital technology background.Opinions on the improvement of rights of producers of phonograms will be taken into consideration.
