《体育规则》第R45条规定了国际体育仲裁院审理普通程序案件时的实体法律适用。该规则虽然尊重当事人选择的法律规则，但在当事人没有选择法律规则时，却一概适用瑞士法，不利于案件的公正审理。另外，由于规则没有规定无须冲突规范指引的国际强制规范的直接适用，同样会给司法实践带来困惑。故应效仿通行的国际做法，对第R45条予以修订。具体而言，首先应将当事人选法的方式限于明示；其次在当事人没有选择时，适用仲裁庭认为适合的法律规则；最后，还要增加国际强制规范适用制度。

The R45 of Statutes of the Bodies Working for the Settlement of Sports-Related Disputes defines the application of substantive law when the CAS hears the cases by ordinary procedures .This provision respects the rules of law chosen by the par-ties ,but in the absence of such a choice ,according to Swiss Law without any exception ,which is not conducive to a fair hearing . Furthermore ,this provision does not define the direct application of internationally mandatory rules which do not need the refer-ence of conflict rules .This has also caused confusions in the judicial practices .In accordance with prevailing international legisla-tions ,the R45 should be revised .More specifically ,the way to the choose law by the parties should be limited to clear expres-sion .Also ,in the absence of such a choice by the parties ,according to the rules of law ,the panel can deem the rules appropriate . At last ,the R45 should add the doctrine of application of international mandatory rules .
