近年来，全国各地暴力伤医事件频发。医患关系不和谐，其中重要的因素是现行法律法规不完善。在医疗纠纷处理方面，《侵权责任法》对医疗损害鉴定无明确规定，导致全国医疗损害鉴定缺乏规范性和科学性；部分地方政府以政府令的形式颁布了医疗纠纷的预防与处置办法，但其法律强制力仍然不够；医疗纠纷调解介入也存在困难。在医师权益保障方面，法律对医师权益规定不明确，落实起来亦较难，医务人员的合法权益得不到保障。在医疗机构治安环境方面，《治安管理处罚法》及由卫生部、公安部联合发布的通告对涉医违法行为虽然作了规定，但是没有得到有效落实；而公安机关的差别对待，一定程度上也使医疗机构治安环境不断恶化，使医师执业安全堪忧。本文提出制定《医疗法》和《医疗纠纷预防与处置条例》，完善落实《治安管理处罚法》相关规定，同时以法律的形式统一医疗损害鉴定，完善医疗纠纷人民调解制度，以保障医患双方的合法权益，促进医患关系和谐。
근년래，전국각지폭력상의사건빈발。의환관계불화해，기중중요적인소시현행법율법규불완선。재의료규분처리방면，《침권책임법》대의료손해감정무명학규정，도치전국의료손해감정결핍규범성화과학성；부분지방정부이정부령적형식반포료의료규분적예방여처치판법，단기법률강제력잉연불구；의료규분조해개입야존재곤난。재의사권익보장방면，법률대의사권익규정불명학，락실기래역교난，의무인원적합법권익득불도보장。재의료궤구치안배경방면，《치안관리처벌법》급유위생부、공안부연합발포적통고대섭의위법행위수연작료규정，단시몰유득도유효락실；이공안궤관적차별대대，일정정도상야사의료궤구치안배경불단악화，사의사집업안전감우。본문제출제정《의요법》화《의료규분예방여처치조례》，완선락실《치안관리처벌법》상관규정，동시이법률적형식통일의료손해감정，완선의료규분인민조해제도，이보장의환쌍방적합법권익，촉진의환관계화해。
In recent years, violent medical incidents happen frequently all over the country, which is mainly due to the disharmony of doctor-patient relationship and the imperfection of the existing laws and regulations.In dealing with medical disputes, The Law of Liability for Infringement does not provide specific provision for the i-dentification of medical injuries, resulting in the lack of normative and scientific medical damage identification;part of the local government promulgated the measures for the prevention and disposal of medical disputes in the form of decrees but it is still difficult to enforce the law; the legitimate rights and interests of the medical staff cannot be guaranteed. In the aspect of medical institutions of public security environment, illegal medical behav-iors are explicitly stipulated in the Law of Punishment for Public Security and A dministration and the notice jointly issued by the ministry of health and the ministry of public security, but it didn't get effective implementa-tion, The public security organ' discriminatory behaviors, to some extent, also make public security environment of medical institutions worsening, and physicians' practicing safety worried. Therefore, in this paper, the author puts forward the following suggestion:making Medical Treatment Law and the Medical Dispute Prevention and Disposal Regulations, improving the related regulations in the Law of Punishment for Public Security and A dministration,unifying medical damage identification in the form of law, perfecting the medical dispute mediation, and protecting the legitimate rights and interests.
