监护人过失致被监护人重伤或者死亡的案件时有发生，然而，在情理与法理的博弈下，实践中却出现司法不统一的现象。应从罪刑法定原则和刑法的一般预防目的出发，追究监护人的刑事责任。此外，监护人应该提高自身素质，国家应当建立健全被监护人社会保障体制，以预防类似事件的发生。

The cases which the guardian's negligence causes the children serious injury or death always happen. However, in the game of legal logos and legal sense, non-uniformity situations emerge in the judicial practice. In the perspective of the principle of legality and general prevention of the criminal law, the guardians, criminal responsibility should be investigated. Furthermore, in order to prevent incidents like that, the guardians should enhance the qualities of themselves, and China should establish and perfect the social insurance for children.
