精神损害抚慰金请求权能否继承的争论由来已久，否定继承和肯定继承两派各抒己见，莫衷一是。在当下，人们物质生活水平提高的同时，比以往更加关注精神世界的安宁与不受侵犯，加强精神损害的救济成为趋势。而且伴随着现代社会文明的进步，社会风险也在不断增加，侵权致人死亡案件层出不穷。继承否定说不合时宜，继承肯定说更能体现对受害人的保护，如今大陆法系和英美法系主要代表国家采取了继承肯定说，而我国司法解释采继承否定说观点，值得反思与探讨。

The debate about whether the claim of spiritual damage can be inherited has been discussed for a long time.Both of the view of denying inheritance and the view of accepting inheritance have pres-ented their arguments in detail.Nowadays,with the improvement of our material life,people pay more attention to their spiritual life.So strengthening the spiritual damage relief becomes a trend with the progress of modern social civilization,the increase of social risks,and torts leading to death emerge endlessly.The view of denying inheritance is out of date.However,the view of accepting inheritance can give the victims better protection.Now the representatives of the civil law system and the common law system adopt the view of accepting inheritance.But the judicial interpretation of our country a-dopts the view of denying inheritance.Therefore it is worthy of rethinking the inheritance fo spiritual damage claim.
