对我国矿山环境管理法律法规进行了梳理，厘清了相关部门的法律职责，总结了国内外矿山环境管理可借鉴的经验。矿山环境综合管理改革要逐步整合不同部门相似的职责，实施渐进式改革，推进大部门制。大部门制改革应充分考虑国土部门所具备的优势，利用好国土资源部的技术支撑力量及已取得的经验，成立以国土资源部门为主导、统一管理矿山环境综合管理部门，完善矿山环境管理相关法律，加强矿山环境监管力度，建立高效可行的公众参与机制等。

In this paper , the mine environmental management laws and regulations were summa-rized, the legal responsibilities of relevant departments were clarified , and experience at home and abroad were also colleted .Mine environmental comprehensive management reform can gradually in-tegrate the similar duties , which dispersed in different departments of the State Council , and imple-ment gradual reform , and steadily push forward the big department system .Big department system reform can fully consider the advantages of the Ministry of land and resources , and make use of ex-isting technical support strength and experience , set up unified management of the department .At the same time, our government should improve laws and regulations of mine environment manage-ment , strengthen the supervision of mine environment , and establish an efficient and feasible public participation mechanism .
