我国新刑事诉讼法中规定的精神病人强制医疗程序存在适用对象范围狭窄、适用条件模糊不清、程序流程以及救济制度缺失等问题，立法上的不完善导致司法实践中缺乏程序保障。构建科学完善的强制医疗制度既保障精神病人的医疗救助，又符合社会正义价值和人权保障的要求。我国新刑事诉讼法应当对强制医疗的适用对象、条件，启动、审理、执行程序、救济制度等一系列程序做出具体详细的规定，构建科学完善的强制医疗程序体系，以实现强制医疗程序在司法实践中的正当程序原则。

The new Code of Criminal Procedure of the mentally ill in the presence of the mandatory medical procedures applicable to the target range is narrow , the applicable conditions blurred , program flow and relief system there are issues such as lack of procedures , inadequate legislation on judicial practice led to a lack of procedural safeguards . With a view to build a sound scientific medical system both to protect the mentally ill and offer medical assistance and to enhance social justice values and human rights protection requirements , our new Code of Criminal Procedure shall apply compulsory medical objects , conditions , start , trial , execution , relief system and a series of programs to make specific and detailed provisions to build a sound scientific system of compulsory medical procedures in order to achieve compulsory medical procedures judicial practice principles of due process .
