随着近几年国内外轮奸案件的频发，如轰动一时的“印度黑公交轮奸案”、“旌德县三男子轮奸一女教师案”、“李某某轮奸案”等，轮奸对社会的影响巨大也成为阻碍社会秩序稳定的不良因素，我国刑事立法将其置为强奸罪的法定加重情节之一予以严厉打击，但该情节的司法适用仍旧存在问题，通过反思立法存在的不足从而探究完善之路径。

The criminal legislation of our country place it on one of the statutory aggravating circumstances of crime of rape to be severely punished. But the circumstances of the judicial application still exist problems. A reflection of legislation are to explore perfect path.
