专利制度由激励技术创新伊始，同时也推动和促进了知识的传播和进步、信息的共享和经济的发展。随之伴随的是专利带来的技术创新的阻碍作用。专利制度的被利用甚至滥用也同时带来了大量的问题专利以及专利丛林、专利阻滞等现象。文章从专利两面性的独特视角着重分析了专利制度的正面和负面作用，并着重侧重后者，对专利在刺激技术创新的同时，同时阻滞技术创新的悖论进行了深入分析思考。对专利丛林、专利阻滞等现象进行分析，并提出解决策略。最后，对专利制度进行再反思和再认识。

At first, patent system is activated by technology innovation and it also promotes the spreading of knowledge and progress, information sharing and the development of economy. Negative effect is brought about by the patent technology innovation effect. The use and abuse of the patent system also brings such phenomena as a lot of questionable patents, Patent Thicket and Patent block Holdup. From patent unique perspective of two sides, this paper emphatically analyzes the positive and negative effect of patent system and mainly focuses on the latter. The paper makes further analysis of the paradox of the patent in stimulating technological innovation and blocking it at the same time. The phenomenon such as Patent Thicket and Patent Holdup is analyzed and the strategy is put forward in the paper. Finally, the patent system is reflected and renewed.
