全球专利申请激增,专利国际申请费用成为专利申请人获得一国专利权必须考虑的成本,主要为价格成本和交易成本。各国政府根据专利国际申请的态势和本国的国情来制定专利申请价格,因地制宜调整专利国际申请所需的费用。同时,许多国家积极参与专利审查国际协作(专利审查高速路)之中,该合作模式本身并不需要支付使用费或仅仅支付少量费用,且能提高专利申请的授权率、减少答复审查意见通知书的次数、降低继续审查请求及申诉率等,从而降低专利申请至授权之间的交易成本,实现资源的优化配置,促进科技创新。

As patent applications are increasing at a high speed globally, international application costs of patent became a problem which should be considered seriously by an applicant. The applicant costs are comprised of price cost and transaction cost. Based on tendency of international patent application and national development, administrative authorities make their decisions of national patenting costs, taking into account of the national condition and giving detailed guidance to patent application. International cooperation mechanism, such as Pa-tent Prosecution Highway( PPH) , has certain advantages in patent application, it can reduce transaction cost, including increasing the grant rate of patent, lowering the average pendency to office action, reducing the rates of request for continued examination and appeal rates. The cooperation mechanism is currently free, or only charges a little fee in certain specific countries. When deciding to utilize the PPH to overlook possible application issues, the applicant may consider its effect of transaction cost reduction. With more sovereignties take part in international cooperation of patent prosecution, optimal allocation of resources and scientific and technological innovation will benefit.
