随着海洋经济的发展及海洋环境资源的开发利用，海洋环境污染事故日益增多，对海洋生态环境的保护构成巨大的挑战。在处理海洋污染事故时，人们以往更多关注的是直接经济损失，而对于海洋生态损害，即海洋生态服务功能、海洋生物资源和生物多样性等方面损害的索赔问题，一直未得到很好的法律解决。为了更好地维护海洋生态利益，法律制度明确海洋生态损害国家索赔主体资格，无疑具有重要的理论和现实意义。

With the development of marine economics and the utilization of marine environmental resources, increasing marine pollution accidents turn up and thus pose tremendous challenges for marine environmental protection. People usually focus attention on direct economic losses in case of marine pollution accidents while neglecting the legal resolving of the compensation claims for marine ecological damage, i.e, marine living resources and biodiversity. So it is of important significance in theory and practice for laws and regulations to make explicit provisions that the state should be the claimant for the compensation on marine ecological damage.
