我国公立高等学校法人自设立之日即存在着各种矛盾，学校法人主体地位不清、政府干预过度、配套制度滞后、政府和学校之间产权界限模糊，使高等教育传统理论在我国大学发展中遭遇碰撞，高等学校在办学实践中法人权利与政府行政权力、与社会力量之间矛盾冲突不断，高等学校法人内部也存在诸多困惑，大学“学术自由”“教授治校”的传统在我国本土化发展与适用中遭遇困境。
我國公立高等學校法人自設立之日即存在著各種矛盾，學校法人主體地位不清、政府榦預過度、配套製度滯後、政府和學校之間產權界限模糊，使高等教育傳統理論在我國大學髮展中遭遇踫撞，高等學校在辦學實踐中法人權利與政府行政權力、與社會力量之間矛盾遲突不斷，高等學校法人內部也存在諸多睏惑，大學“學術自由”“教授治校”的傳統在我國本土化髮展與適用中遭遇睏境。
아국공립고등학교법인자설립지일즉존재착각충모순，학교법인주체지위불청、정부간예과도、배투제도체후、정부화학교지간산권계한모호，사고등교육전통이론재아국대학발전중조우팽당，고등학교재판학실천중법인권리여정부행정권력、여사회역량지간모순충돌불단，고등학교법인내부야존재제다곤혹，대학“학술자유”“교수치교”적전통재아국본토화발전여괄용중조우곤경。
It has existed various contradiction since a public university as a legal person was established in modern China.With the development of university, traditional theory on tertiary education encounters various pre-dicaments resulted from indistinct principal status of a public university, excessive intervention by the government, hysteresis of relevant institution and ambiguous boundaries of property rights between the government and a universi-ty.On the other hand, during the education practice, there are more paradoxes among corporation rights, govern-ment administrative power and social forces.Moreover, corporations of public universities are at a loss.The tradi-tion of academic freedom and management by professors encounters predicament during development of localization in China.
