以《北美自由贸易协定》( NAFTA)中投资专章的环保规则为研究对象,并结合两个典型的案例,运用案例分析的方法,探究目前世界上处理国际投资与环境保护的冲突的做法。经研究表明,虽然NAFTA采取了在投资专章纳入环保规则的一种新的立法模式,试图去协调投资利益和环保利益,但实践中NAFTA未能较好地处理投资与环保的冲突,仲裁员屡屡牺牲了东道国的环保目标。最后仔细分析了出现此种研究结果的原因,根据研究结果对我国提出了相关建议,以便我国在签订对外投资协定时能吸取NAFTA的经验教训,较好地处理投资与国内环保的冲突。

Based on the environmental rules in Chapter 11 of North American Free Trade Agreement ( NAFTA) and combined with two typical cases , the way to settle down the conflict between international investment and en-vironmental protection worldwide in recent times is explored.The results show that the signing of NAFTA is deemed as a landmark in environmental protection , which tries to balance the conflict between international in-vestment and environmental protection , however in practice , NAFTA fails to coordinate this conflict effectively , and the aim of environmental protection of a host country also fails to achieve.Finally, the reason why this hap-pened is analyzed.? According to the results , advice to our government when it signs the foreign investment a-greement with other countries in the future is given , so that China can learn some experience from NAFTA when dealing with the conflict between the investment and domestic environmental protection.
