随着我国经济的高速发展，城镇化建设进程进一步加快，非物质文化遗产正在快速地消亡。如何建立科学完善的法律制度来保护非物质文化遗产成为我国立法和实践的当务之急。虽然我国在研究如何用法律来保护非物质文化遗产方面已经取得了巨大的进步，但是实践中也发现了很多立法需要完善的地方，比如法律制度上存在的漏洞、立法语言的过于简洁等。非物质文化遗产作为全人类的共同财富，理应由行政法来规范和保护。分析研究我国目前行政法在保护非物质文化遗产中存在的不足，提出有针对性的建议，以期对完善非物质文化遗产的法律保护有所裨益。

With China’s rapid economic development and further acceleration of the urbanization process,the non-material cultural heritage is disappearing rapidly.How to create a scientifically sound legal system to protect Chi-na’s intangible cultural heritage has become a legislative and practical urgency.Though we have made great pro-gress in recent years in the study of how to use the law to protect intangible cultural heritage,we have realized that a lot of legislations needed to be perfected.For example,There are loopholes in the legal system.The legislative term is too simple,etc.As a common heritage of the mankind,the intangible cultural heritage should be regulated and protected by the administrative law.This paper analyzed the existing deficiency of the administrative law in pro-tecting the intangible cultural heritage and put forward some concrete suggestions so as help perfect the legal protec-tion of non-material cultural heritage.
