作为我国刑法明确规定的唯一资格刑，剥夺政治权利并不违背宪法的规定。言论、出版、集会、结社、游行、示威这六大自由并非都属于政治权利的范畴，也是无法剥夺的。对严重破坏社会秩序犯罪剥夺政治权利的适用对象规定不明确，我国不应该对被判处死刑立即执行的罪犯和未成年犯适用剥夺政治权利。我国刑法应当参照有关国家的做法，采用剥夺政治权利刑的选择剥夺制。
작위아국형법명학규정적유일자격형，박탈정치권리병불위배헌법적규정。언론、출판、집회、결사、유행、시위저륙대자유병비도속우정치권리적범주，야시무법박탈적。대엄중파배사회질서범죄박탈정치권리적괄용대상규정불명학，아국불응해대피판처사형립즉집행적죄범화미성년범괄용박탈정치권리。아국형법응당삼조유관국가적주법，채용박탈정치권리형적선택박탈제。
