近几年，我国的互联网金融业务量呈井喷式发展，多种形式的互联网金融业务竞相发展，但在现有金融监管体制下，立法和监管滞后，监管真空或监管重叠并存，使得我国互联网金融风险不断积聚，改善和加强对其的监管已是当务之急。本文对我国互联网金融发展和监管中存在的问题进行了梳理，在借鉴欧美发达国家互联网金融立法和监管成功经验的基础上，提出了加强我国互联网金融法律规制的有效建议，完善互联网金融相关法律制度规定，健全监管体制，加强互联网金融消费权益保护，切实防范洗钱风险等，以支持互联网金融健康有序发展。

In recent years, internet financial business has undergone a growth spurt, and a variety of businesses flourish. But legislation and supervision lags behind and there exist regulatory vacuum or overlapping under the existing financial regulatory system, which has made the risk of China's Internet finance continue to accumulate. And current-ly, it is imperative to improve and strengthen supervision. This paper sums up the problem occurring in the develop-ment of China's internet finance and corresponding regulation. Based on drawing on the successful experience of the leg-islation and regulation of internet finance in America and other developed countries in Europe,this paper puts forward effective proposals to strengthen our legal regulation of the internet finance, improve the internet finance-related legal systems,establish a sound regulatory system,strengthen the protection of financial consumers’rights,and effective-ly guard against money laundering risks to support the healthy and orderly development of the internet finance.
