从原则上讲,只要是为J了实现行政管理目的或为了实现公益,在其权限范围内,行政主体都可以运用行政合同.在医药卫生事业中,通过行政合同,政府在提供医药卫生公共产品时的出资人地位得到了明确,卫生行政主体在医药卫生事业中的行政管理特权和提供服务的行政责任也更加确定;同时,通过协商吸收行政相对人参与到行政活动中,并将其利益反映在合同中,行政执法更易被接受;而且,行政主体间的协作配合被合同固定下来,各行政主体的职责也会更加明晰.
